Richard Nicholas chaired the discussion, and the speakers provided updates on the current position and recommendations on how to avoid and minimise the risk of adverse consequences flowing from Covid-19.

  • Employment issues - The job retention scheme; how to deal with sick pay, self-isolation and sickness absence; and the support available for self-employed contractors.
  • Funding matters - Eligibility for the Coronavirus Business Interruption Loan Scheme (CBILS) or Covid Corporate Financing Facility (CCFF) the relevant application processes, security requirements and how eligibility is affected if alternative sources of funding are available.
  • Property issues - Whether tenants should withhold rent; how to approach landlords for concessions and the type of concessions that landlords are offering; and how you can claim Business Rates relief.
  • Commercial/contract - Common contractual issues including: how to identify ways to terminate or suspend existing contracts; the extent to which suppliers can be compelled to continue performing contracts; force majeure provisions; and the common law concept of ‘frustration’.
  • Disputes/litigation -  Main areas which are likely to give rise to contractual disputes arising from the Covid-19 pandemic; practical steps businesses can take to manage and reduce those risks; and how the courts are handling ongoing litigation during the lockdown period.
  • Insurance issuesThe key insurance considerations arising from the Covid-19 pandemic and how likely you are to be covered if your business suffers as a result of the government’s enforced lockdown.
