Construction
Our construction sector specialists are trusted to provide advice, support and guidance to national and international construction clients. Underpinned by our firm-wide values, our deep understanding of the key issues and market drivers impacting the future of the built environment (both now and in the future) we are one of the most respected legal teams working across the construction sector.
Acting for a range of clients at all points of the supply chain means we know the market. And, importantly, it means we understand what is required to achieve the right result. We work with a range of developers, contractors, subcontractors, purchasers, tenants and funders in the sector.
Our construction team advises on every aspect of the contractual process, ranging from contract procurement & supply chain strategy, heads of terms, drafting and negotiating contract documents, and day-to-day operational issues during the ‘live’ period of the project. We also advise on project management and, when necessary, the resolution of disputes, whether through a formal procedure or via some form of alternative dispute resolution (ADR).
At Browne Jacobson we’re recognised for our broad and deep expertise in all matters relating to the construction sector, including providing advice on regulatory issues, such as sustainability and building safety), corporate restructures, insolvency, counter fraud, data protection compliance and data strategy, employment, planning and the legal impacts of digital transformation and the protection of intellectual property rights.
Featured experience
A local authority
Advising two councils in relation to the valuation of an EFW plant, following the termination of the PFI contract under which it was built as a result of the contractor’s failure to pass the tests on completion by the longstop date. The legal and technical issues are complex, with the value of the dispute being in excess of £200m.
A laboratory testing services company
Our private equity dealmakers advised Palatine Private Equity backed CTS Group on its acquisition of In Situ Sit Investigation, a market leader in Cone Penetration Testing and Pressuremeter techniques and ground investigation services.
A leading contractor
We have been advising a leading contractor on the collection of ED&I data from its own staff and its supply chain. That contractor is increasingly being asked to provide aggregated and anonymous statistics related to its ED&I practices as part of bids and some of its clients ask for reporting on an ongoing basis. Ensuring such information is collected compliantly is crucial.
A cladding related client
We regularly advise on cladding related matters and disputes and have recently advised a client involving fact specific and complex claims relevant to building regulations and any remedial works required.
