Tim leads the Browne Jacobson construction and engineering team. He has extensive experience of advising in relation to UK and international projects. Whilst the majority of Tim’s work is contentious, ranging from dispute avoidance / project management through to formal disputes, he also undertakes non-contentious work.  

Tim’s experience includes renewable energy facilities (including hydroelectric, biomass, wind, solar and waste to energy), major infrastructure projects (including road widening, waterways and hospitals), large residential and commercial developments (including large retail stores, student accommodation and multi-use buildings), and major government projects.  

Tim has significant expertise in relation to the issues arising out of the Grenfell tragedy, including defending clients against claims arising out of the same and advising major international insurers with regard to relevant coverage issues. He has also written numerous articles and provided seminars on the topic.  

He has also advised regarding payment issues under the Construction Act, claims arising out of the Covid-19 pandemic, and the extent to which the Ebola outbreak amounts to an event of force majeure. He has experience of court proceedings, international arbitration, adjudication, mediation and bespoke dispute resolution procedures.

Cladding / fire safety

Continuing to advise the subsidiary of a major national supplier of energy in relation to numerous claims against it relating to façade and fire safety work, brought under relevant pre-action protocols, including regarding compliance with relevant Building Regulations and the extent (if any) of remedial works required.

Student accommodation – Covid-19 / waterproofing

Acting for a developer regarding various issues, including (1) the contractor’s right to an extension of time arising out of Covid-19; and (2) the certification of practical completion where issues exist regarding the design detail for the waterproofness of the building, likely to be an increasing issue in coming years.

Major cladding manufacturer – insurance issues

Continuing to advise a major international insurer in relation to coverage issues arising in relation to various major and high-profile claims arising under the insured’s professional indemnity policy, including issues relevant to renewal.

Major infrastructure scheme – cost overruns

Acting for a Borough Council with regard to issues arising out of a major road widening scheme. The projected cost of completion was almost double the initial budget. We advised regarding the Council’s ability to recover the cost overrun from third parties, claims arising out of Covid-19, resulting settlement and the revision / restatement of the contract.
