Advising an academy acting as landlord in relation to a free school project involving both purpose-built temporary accommodation and a new permanent building, with issues such as shared use, collateral warranties, construction issues and need for the consent of the Secretary of State for Education.
Acting for an academy trust in connection with their entering into a development agreement with a sports provider in respect of two agreements for lease and leases in relation to areas of a school site for the installation of new five-a-side football pitches and a pavilion. Complex issues were involved including shared use, extensive warranty protection and bespoke EFA consent.
Advising an academy trust in respect of the development of a new targeted basic need school. The client was acting as tenant and we negotiated with the council to put in place a development agreement obliging the council to enter into a design and build contract with a third party contractor to deliver the school. The documentation was based on the EFA prescribed form documentation amended as appropriate to deal with the site specifics and deliver the necessary construction protection to the client. The council’s historic title was a patchwork of over 30 historic land registry interests which led to challenging site assembly and issues flowing from extensive pre exchange investigation.
Acting in relation to the construction of a new SEN and secondary school, located within the same building with a number of shared use issues, complex issues of site acquisition by the local authority, relocation of a sports centre and other occupiers, and negotiation of access rights.

The team is experienced with all aspects of education law in relation to the various property transactions required in these projects, including leasehold and freehold transactions, shared use agreements (including leisure centres), sure start centres, nurseries, caretakers' tenancy agreements and substation and telecoms leases.
