This session, led by Ed Pollard and Rebecca Fitzpatrick, will provide delegates with an understanding of the legal frameworks and best practice when managing children with complex mental health and behavioural needs who are in crisis.
Delegates will learn from real world experience and case studies, to illustrate how these legal frameworks should be applied in complex cases involving children in mental and behavioural health crisis on the frontline of health and social care.
Chaired by Rebecca Fitzpatrick, who heads Browne Jacobson’s health advisory and inquest team and sits as a First-Tier Mental Health Tribunal Judge, we will hear insights from a panel which will include:
- Professor Ralph Sandland and Dr Grace Carter, academics from the University of Nottingham’s School of Law and Co-Directors of the Centre for Mental Health and Human Rights.
- Ed Pollard, Partner at Browne Jacobson.

High Court confirms it's unlawful for assessments for detention under s.2, s.3, s.4 and s.7 Mental Health Act 1983 to be conducted remotely
On 22 January 2021, the High Court confirmed that under the Mental Health Act 1983, the phrases “personally seen” in s. 11(5) and “personally examined” in s. 12(1) require the physical attendance by the AMHP and s.12 Doctor on the patient when an assessment is being carried out for detention under the Act.
