Multi Skilled Visit: what is the impact of it being a right under the new Electronic Communications Code?

A Multi Skilled Visit (MSV) is when a survey is carried out on behalf of operators for the purpose of seeing whether a new site is suitable for the installation and operation of electronic communications equipment.

A Multi Skilled Visit (MSV) is when a survey is carried out on behalf of operators for the purpose of seeing whether a new site is suitable for the installation and operation of electronic communications equipment.

The Court of Appeal in The University of London v Cornerstone Telecommunications Infrastructure Limited [2019] decided that MSVs were a code right under the new Electronic Communications Code (“the Code”). Additionally it was also found that operators can carry out MSVs on an interim basis under paragraph 26 of the Code. This makes it easier for operators to apply for such rights and more difficult for occupiers to refuse such visits.

In practical terms it will now be cheaper and easier for operators to carry out MSVs and therefore it is likely more MSVs will be carried out as a result. Additionally occupiers will receive much more limited compensation from operators when MSVs are carried out.
