James is an associate in our advisory and inquest team. He advises a range of public body clients in relation to several areas, including the Court of Protection (mental capacity), the Mental Health Act, serious medical treatment cases and inquests.
Having trained with the firm, James has undertaken secondments a key health client. Prior to joining the firm and specialising in advisory and inquests law, James previously worked in London at a think tank and in the in-house legal team at a global construction company.
In circumstances where it is subsequently proved that an individual does have such a mental disorder, there is a presumption that their carer either knew or could reasonably have been expected to know of the disorder, unless sufficient evidence is adduced to rebut that presumption.
The Mental Health (Hospital, Guardianship and Treatment) (England) (Amendment) Regulations 2020 have been laid before Parliament and come into force today - 1st December 2020.
