Shared insights: Corporate and gross negligence manslaughter in the health and care sector

This Shared Insights forum took place on 18 November 2025.
This session focused on the practical implications of an increasing trend towards corporate and gross negligence manslaughter investigations including:
- The legal framework.
- Relationship with independent and public inquiries.
- Interactions with internal processes including disciplinary and other internal investigations.
- Implications for inquest preparation.
- The status of reflective notes.
We also covered the legal framework and looked to previous prosecutions and ongoing investigations for lessons about what differentiates those circumstances from other patient deaths.
This session was chaired by Carl May Smith, criminal and regulatory Partner at Browne Jacobson. Our panel of speakers shared their experience and expertise to share learning from previous prosecutions and ongoing investigations:
