Gavin is a partner in our construction team. Recognised as a ‘Rising Star’ and described as a “name to note” in The Legal 500, Gavin specialises in construction dispute avoidance and resolution, and supports the response of construction product manufacturers, contractors and developers to the new regulatory regime introduced by the Building Safety Act. 

Acting for household name SME and PLC construction product manufacturers, Tier 1 contractors and national sub-contractors, Gavin draws on his understanding of the commercial drivers of all parties involved in a construction project to provide the pragmatic and solution-focused advice which his clients value, both downstream and upstream. His excellent technical understanding of construction products and projects enables him to engage with personnel with regards the detail of disputes in a practical way, and has been recognised through his appointment to the London board of the Federation of Master Builders.

Gavin is working with organisations in the construction and manufacturing sectors to assist with internal knowledge management in relation to the new regulatory regime introduced by the Building Safety Act, to assess the risk profile for the organisation, personnel and any associated companies in the new regulatory landscape, and to develop strategies for managing the associated risk. Gavin regularly presents to a range of stakeholders on the Act, including the Consortium of Local Authorities in Wales, the Federation of Master Builders, and the Metal Cladding and Roofing Manufacturer’s Association.

Leading professional indemnity insurer

Appointed by a leading professional indemnity insurer to act on behalf of a firm of surveyors in the defence of a claim for damages in excess of £6 million arising from a contract for the provision project monitoring services in relation to the refurbishment of a commercial unit. The claim involves issues in relation to the duties owed by project monitoring surveyors and the obligation of a party to mitigate its loss through the carrying out of remedial works.

Main contractor

Acting on behalf of a main contractor specialising in prime real estate in the defence of a claim by a sub-contractor for delay-related loss and expense in the sum of £750,000. The claim involves novel issues regarding the entitlement of a contractor in delay to claim a contribution to head office overheads / loss of profit as a consequence of having allegedly lost work during the delay period and, in particular, whether profit made on contract variations during that period should be set-off from any such claim.

NHS trust

Acting on behalf of an NHS trust in the defence of a claim by a modular unit supplier for damages of £1.1 million arising from a prospective contract for the design and supply a mobile ambulance handling unit. The claim involves issues in relation to contract formation and alleged tortious interference which will have a significant impact on the balance of the financial position between the parties, and the expenditure of public funds.

Appointed by a leading professional indemnity insurer to act on behalf of a high end stone fit out specialist in the defence of a claim for damages in excess of £5 million arising from a sub-contract for the supply and installation of stone flooring and walling as part of the refurbishment of a luxury hotel and residential project in Central London. The claim involves technical issues in relation to the method of installation and specification of a range of product types.
