'Grades without exams: what schools can do now to avoid legal risks and challenges' webinar

This session explores what we know so far about grade determination plans, highlight potential legal risks and challenges for schools, and identify what steps should be taken by senior leaders, governors and school staff now.

16 March 2021

This webinar took place on Tuesday 16 March 2021 and is now available on-demand. The content in this recording was correct as of the original webinar date.

In the absence of exams, the Department for Education (DfE) and Ofqual have published their joint decision on how GCSE, AS and A level and vocational and technical qualification grades will be determined in summer 2021.

Whilst further guidance from exam boards is awaited, this session:

  • explore what we know so far about the grade determination plans
  • highlight the potential legal risks and challenges for schools; and
  • identify what steps should be taken by senior leaders, governors and school staff now to avoid or mitigate those risks.

Topics that were covered include:

  • Data protection considerations
  • Bias, discrimination and challenges under the Equality Act 2010
  • Complaints and appeals

Throughout the webinar a significant number of questions were posed. The responses to these can be found on our Gradings without Exams – Frequently Asked Questions page.

This session is the first in a series of planned webinars designed to support schools as they look to implement the DfE/Ofqual decision.

A follow-up session will be held on Tuesday 20 April at 3:30pm and a final one in early August.
