This morning (6 June) the Supreme Court has handed down its decision in Poole Borough Council v GN and another. The court dismissed the appeal and upheld the decision in the lower court that the claim should be struck out. In NA (Armes) v Nottinghamshire County Council the Supreme Court ruled today that whilst local authorities do not owe a child in foster care a non-delegable duty, a local authority can be held vicariously liable for the wrongful actions of foster parents to a child in foster care.
