UK subsidy control system to go live on 4 January 2023

The complex and rather nebulous transitional subsidy control regime set out in the UK-EU Trade and Co-operation Agreement and the UK’s wider international commitments has made it difficult for public authorities and those working with them to proceed with certainty where subsidies are involved.

The complex and rather nebulous transitional subsidy control regime set out in the UK-EU Trade and Co-operation Agreement and the UK’s wider international commitments has made it difficult for public authorities and those working with them to proceed with certainty where subsidies are involved.

However, brighter days are on the horizon following the Government’s announcement that the new domestic subsidy control regime under the Subsidy Control Act 2022 (and presumably the various Regulations made under it) will come into force on the 4 January 2023. The commencement of the Act and associated Regulations will bring some much-needed certainty to bodies giving out subsidies, in particular by introducing some long-awaited “streamlined subsidy schemes” which will allow bodies to give out subsidies without having to conduct an assessment against the subsidy control principles.
