Extension of the RTA scheme to include employers and public liability claims 26 November 2012

The CPR Committee consultation on the proposed pre action protocol for low value EL, PL and motor claims (up to the value of £25,000) concluded last Friday. You can read our response here by clicking on our link below.

Extension of the protocol has been controversial, but the Government has made that decision following its February consultation. The CPR Committee has been concerned solely with the process, but given the wide range of claims potentially captured by the new protocols, process will be a very important factor in determining whether the protocol is a success or not.

Coincidentally, the Governments response to a letter of action from the Association of Personal Injury Lawyers (APIL) in connection with possible judicial review of the process by which the Government has introduced the process, was also due on Friday. APIL have yet to confirm whether they will proceed with the Judicial Review.
