Accident Group Test Cases, Senior Costs, 16 February 2004

The facts

Claimants and Defendants in the Accident Group (TAG) Test Cases have mediated an agreement in relation to the compliance issues (recoverability of Solicitors costs) surrounding the TAG Panel Solicitors costs. Accordingly, the Hearing before Master Hurst has now been vacated. TAG Panel Solicitors costs will now be settled subject to a discount of 25% being applied to agreed/assessed base costs in the majority of cases. A discount does not apply where the TAG Panel Solicitor promptly gave the Regulation 4 advice himself. The Claimant’s Solicitors have agreed not to recover any short fall in their costs from the Claimant themselves.
