payments into court update

4 March 2003
The facts

Please note that as from the 1st April there is a significant procedural change in the Rules regarding Part 36 Payments. As from 1st April, the party wishing to make a Part 36 Payment must file the Notice in the home Court and serve it in the usual way, but must send the cheque to the Court Funds Office with form 100, together with a sealed copy of the Claim Form and, above all, a cheque made payable to the Accountant General of the Supreme Court.

Comments

From a humble Practitioner’s point of view, it seems somewhat retrogressive to return to the rather cumbersome old High Court Practice.
