We are pleased to invite you to our first independent healthcare in-house lawyers' forum for 2023 which is focusing on claims, inquests and regulation. We will be covering the following topics:

  • Independent Health Inquest Update with Amanda Wright-Kluger; and
  • Two of the following:
    • Complaint Response and Dispute Avoidance with Damian Whitlam
    • Regulatory Update with Carl May-Smith – including a progress report on the delayed CQC new regulatory model and the impact on delays in social care reforms
    • Mental Health Law Update with Rebecca Fitzpatrick – including an update regarding the reform of the MHA & LPS, progress on Derbyshire Healthcare NHS FT v SoS for Health and Social Care (legality of remote MHA assessments for renewals, CTOs and CTO renewals), Cumbria Northumberland Tyne & Wear NHS FT & SoS v EG 2021 (use of long term MHA s.17(3) leave), The Secretary of State for Justice v A Local Authority & Ors [2021] (Potential criminal offence for care workers to assist people with mental disorders in securing the services of sex workers), JB [2020] Supreme Court decision – (test for capacity to engage in sexual relations) and Moon v Lancashire and South Cumbria NHSFT 2022 (employment status of hospital managers).
    • Investigations, Inquiries and PSIRF 
    • Covid Recovery with Lorna Hardman - Overview of likely claims arising from the Covid-19 Pandemic and how the courts are likely to approach this. Topics would include nosocomial infection, employee claims, Equality Act and Human Rights Claims and the impact of telemedicine. Discussion on how the Covid inquiry is likely to affect claims.

The event will be chaired by head of independent health, partner Clare Auty, and there will of course be plenty of time for discussion and questions, so we do hope you can come along.

We are aware that this focussed session may appeal to different members of your legal teams (who avoid the normal sessions on NHS contracts and procurement etc.).
