enhancing environmental education
the challenge:
The Countryside Council for Wales (CCW) required advice in
relation to a lease of land at Newport Wetlands Reserve to the
Royal Society for the Protection of Birds (RSPB), who planned to
construct and operate an environmental education centre on the
site. CCW did not want the development of the centre to adversely
impact upon its use and operation of the site and a solution was
required for the phasing of tenant’s works.
our approach:
We worked closely with the RSPB’s solicitor to meet key
deadlines and resolve queries. An early access licence was agreed
to allow works to commence, eliminating construction delays. We
prepared and discussed several drafting solutions to deal with the
proposed phase works – including phased trigger dates and
pre-agreed forms of licences for alterations. We drafted the
agreement for lease and the lease to meet CCW’s objectives and put
forward ideas regarding the best mechanism to allow CCW and the
RSPB to share the facilities.
the result:
Creation of a simple suite of documents to meet CCW
requirements; flexibility for the RSPB in relation to the phased
works, which were to be carried out in line with specific planning
permissions; certainty for CCW as to the actual work permitted.
