Advising a software company, on an offshore outsourcing of development work to India, whilst ensuring that any future developments owned by our clients were in accordance with existing protocols, were kept secure and the team involved was consistent.

our approach:

We spent time looking into the client’s concerns and past experiences in order to further understand their concerns. Taking advice from Indian contacts we also investigated the practical issues involved in ensuring that an Indian court would be able to enforce contractual terms we wanted to include.

the result:

We were able to create a contract robust enough to deal with the risks that the client faced at the time and looking into the future, particularly on termination of the contract. Our agreement clearly set out expected service levels to take account of the client’s concerns over consistency, standards and security.
