Securing a periodical payment order for a catastrophic injury claim

 

the challenge:

A road traffic accident resulted in a catastrophic injury, leaving the claimant requiring round the clock care, which was pleaded at up to £11 million. The defendant was seeking a periodical payment order (PPO) to enable damages to be paid as annual payments throughout the lifetime of the claimant, rather than as a lump sum.

our approach:

We used our in-house investigators to clarify the liability issues at an early stage and also arranged for rehabilitation and medicolegal experts to control and monitor the treatment programme and hence minimise the outlay for the defendant. We also liaised with the treating NHS Trusts and local authorities to investigate future care provision for the claimant.

the results:

A PPO based outcome was secured, equivalent to an £8.3 million lump sum; case law established on the burden of proof in respect of contributory negligence.
