independent school scrutiny by Charity Commission
the challenge:
The Charity Commission was concerned that the current objects of
an independent school specialising in provision for students with
physical disabilities and learning difficulties did not reflect the
charity’s current beneficiaries. The trustees were concerned that
the Charity Commission might consider them in breach of their
duties by accepting students who did not fit the current
objects.
our approach:
We began by drafting new objects for the school, working with
the trustees to ensure that these suited their aims and the needs
of current beneficiaries whilst allowing the charity the
flexibility and scope to develop and expand in the future.
Conducting successful negotiations with the Charity Commission
convinced them that the amendments were not detrimental to current
students and that the expansion of the class of potential students
would not stretch the charity financially.
the results:
A modernised, fit for purpose charity and a significant
reduction in the risks to the trustees.
