contracts for mixed use development
the challenge:
To draft construction contracts for a major town centre
re-development in Huntingdon being let in three separate packages –
each with a separate building contract and its own consultants’
appointments. The contracts had to protect our client, Clegg
Developments Limited, be acceptable to the consultants and
contractors, and also to anticipate the likely requirements of the
funders and end users which were unknown while the contracts were
being negotiated.
our approach:
We used our experience to pitch the contracts and appointments
appropriately. When the requirements of the funders and end
users were known, the contracts could be finalised relatively
quickly and with minimum further amendment.
the result:
Having the right contracts assisted Clegg Developments to secure
funding and agreements for leases without being distracted by undue
renegotiation of the underlying construction contract
documentation. The first phase has been successfully
completed and phase two is well underway.
