Fast track adjudication process for invoice dispute

the challenge:

A Housing Trust entered into an agreement with a maintenance contractor to carry out day to day repairs and planned maintenance to the Trust’s social housing stock.  A dispute arose over an alleged failure by the Trust to make payments against interim invoices and the contractor commenced adjudication proceedings.

our approach:

The Trust’s main concern was that it didn’t have enough supporting information to verify the invoiced sums and so was unable to pay them.  The Trust processed and made part payments against some invoices and queried others.  We responded quickly so the client did not fall foul of the fast track adjudication timetable.  We reviewed and evaluated a large volume of documents held by the Trust, project managed the gathering of evidence and information and ran the adjudication.

the result:

The adjudicator rejected the adjudication, agreeing with the Trust that the maintenance company had not proven their entitlement to further payment; the Trust was able to meet the fast track adjudication timetable.
