clarity guide to leasehold liability
how we can help
Our Property Litigation Team provide specialist advice on
managing and protecting an organisation’s property.
The team starts by identifying strengths and weaknesses and
advising on tactics, aiming to achieve client objectives at a cost
which reflects the value and importance of the case. Aware that
disputes can often be disruptive, the team pursues a swift result
through negotiation, alternative dispute resolution or court
proceedings, whilst protecting the ongoing landlord and tenant
relationship. Our specialist services include:
- Property management – pro-active management of your real estate
assets from lease renewals through to break clauses and service
charges. We work closely with your surveyor and our property team
to ensure we achieve your aims
- Possession proceedings – whether individuals come onto your
demise without permission or you need to seek repossession from any
sub-tenants, we provide swift pragmatic advice and action to ensure
you get your property back
- Landlord and tenant disputes – resolving disputes by a variety
of means, ideally through negotiation or mediation, but where
necessary by litigation or arbitration
- Rent reviews – working closely with your surveyor and you, we
look after clients' interests through advice on the interpretation
of rent review clauses, negotiation and representation in
arbitration, etc where necessary
- Dilapidations – working in conjunction with your surveyor, we
provide expert advice on the extent of your repair liabilities
under the lease and advise on arguments to reduce the landlord’s
claim, including diminution in value and supercession.
- Service charges – we can assist you by providing advice on the
interpreation of the service charge clause to ensure the property
is being managed effectively by the landlord and, in particular,
within the terms of the lease
- Disputes over property rights – we handle a variety of
disputes, including matters surrounding rights of way, rights of
light and breach of restrictive covenants
