procurement process dispute

the challenge:

A public sector organisation faced a dispute as to whether the award of a contract had been made under a flawed procurement process.  Our instructions were to review the procedure and advise on any potential liability.  This needed to be done without de-railing the contract award procedure, which would have potentially delayed the project.

our approach:

We undertook a complete review of the procurement process to identify the potential risks for the client.  This identified actions that should be taken to enable our client to respond proactively to the challenge it was facing, ensuring that steps could be taken to prevent further disputes arising from the review.  The suggested actions also allowed the process to continue with minimum disruption, which was an important objective for our client.

the result:

The client completed the actions we identified as part of our review and was able to proceed to contract award with minimal delay in the procedure.  An effective handover of services was also secured, thus achieving their aims for the project.
