transfer of a private hospital
the challenge:
To complete the transfer of a private hospital from a private
finance partner to an NHS organisation within a window of 12 weeks
under the direction of the Secretary of State.
our approach:
We adopted a positive and pro active approach to the land
investigation and due diligence exercise by commissioning searches
and obtaining title documentation early. We made great efforts to
find ways to resolve difficult issues in shortened timeframes
relating to both property and commercial issues, where the
objectives of three different parties inevitably pulled in opposing
directions. Our approach was to take a sensible, commercial view of
the risks and liabilities which arose for our client and to
encourage regular, open discussion between the parties to achieve
the transfer by the required date.
the results:
The transfer was achieved on the target date with all parties
satisfied, and in the process continued hospital services to the
community were secured.
