advising a PCT on split of commissioner and provider arms
the challenge:
To advise our primary care trust (
PCT
) client on the risks and further
implications of the legal split of commissioner and provider arms
of the
PCT
, pursuant to
the Department of Health’s "Transforming Community Services"
requirements. Thereafter acting on behalf of the
PCT
transferring the services out of
commissioner control and putting in place all requisite
occupational arrangements.
our approach:
We prepared a comprehensive report for the benefit of the
commissioner and provider trust boards, highlighting the major
issues of risk and practical solutions for dealing with the
competing interests of landlord and tenant service providers. A
straightforward format was used to explain the issues and explore
the options available to the
PCT
, avoiding legal jargon and
focusing on the issues which the
PCT
would face both at a strategic
level and also “on the ground” in delivering community health
services. We put in place an organisational transfer agreement and
subsequently put in place property arrangements for the new
providers to occupy the premises.
the results:
The outcome was a speedy and successful split of provider and
commissioner services with the
PCT
appraised of the issues and
occupational arrangements to suit all parties put in place.
