the challenge:

A client wanted to set up a 'send to a friend' mechanic whereby visitors to its site had to insert their friends’ email addresses to gain entry into a prize draw. Use of this mechanic is technically a breach of European Regulations on data protection as companies are prohibited from sending unsolicited emails without first having the consent of the recipient.

our approach:

Our menu of marketing compliance services allowed the client to choose the 'send to a friend' menu option, knowing that they would be charged a straightforward £500 fixed fee and receive the advice within a guaranteed turn around of five working days. We were able to advise the client on a way of using the 'send to a friend' mechanic that was in accordance with guidelines issued by the UK regulator of data protection laws.

the result:

With certainty on fees and the ability to launch the prize draw quickly, the client was able to set up the mechanic, comforted that should it receive a complaint in relation to a potential breach of the European Regulations, it would be able to resist such a challenge and produce a full audit trail.
