contractual claim against a trade debtor
the challenge:
We were instructed on behalf of a major clothing distributor
which was owed a significant sum from one of its customers. The
customer was threatening to bring a substantial counterclaim, with
the total value in dispute in excess of £750,000. Matters were
further complicated by the customer going into administration and a
subsequent dispute between our client and the customer’s trade
credit insurer.
our approach:
We were able to use our considerable experience in insolvency
matters to the client’s advantage. Complex points of law were
addressed by a number of our lawyers drawing expertise from across
the firm. We were also able to bring our depth of expertise to bear
in negotiations with the customer’s insurance company under the
Trade Credit Policy.
the result:
The counterclaim was defeated and the claim was settled for a
sum that was favourable to our client. Overall, our client was very
satisfied with the outcome of the litigation and our ability to
successfully overcome the various challenges that occurred.
