negotiation of a mesothelioma claim
the challenge:
Our client faced a claim by a deceased’s estate for damages
arising from mesothelioma; following exposure to asbestos spanning
over 50 years, during which time the deceased had been employed by
two employers. The premises at which the deceased worked for our
client no longer existed and the former employees could not be
located.
our approach:
We directed our clients to access archive records held by them
having provided a “wish list”, avoiding additional costs of
conducting a full search. Using the deceased’s medical evidence and
statements from other parties, we demonstrated to the co defendants
that our clients could show that they had not materially exposed
the deceased to asbestos. Finally, using the same evidence, we
negotiated with the claimant’s solicitors that they need only
pursue one defendant and drop the claim against our client.
the results:
Persuasive negotiations on a complex claim convinced the
claimant to stay proceedings against our client which resulted in a
significant cost saving.
