defending multi track proceedings
the challenge:
Our client, which operates within the printing and direct mail
industry, is the parent company of a large group of companies.
Proceedings were issued by a manufacturer who supplied a number of
companies within the group. Our challenge was to persuade the
claimant and the court that the correct defendant was not our
client. The situation was complicated by a lack of clear
paperwork.
our approach:
Keeping in close contact with our client’s managing director
ensured we understood their objectives and the external factors
which were affecting the company and its cash flow. We advised our
client on the merits of the claim and the litigation risk. Tactical
Part 36 offers were made to take account of this and at the same
time we systematically prepared the case for trial, ensuring that
no stone was left unturned.
the result:
The matter went to trial and our client successfully defended
the claim; the claimant was ordered to pay costs and to make a
substantial interim payment prior to these being assessed.
