the challenge:
Our client, a local small and medium sized enterprise, wanted to
license an income-generating website to a global media company.
They needed to retain control of the intellectual property rights
and ensure the deal was non-exclusive in order to allow for further
commercial opportunities. The website would not start to generate
significant income until the deal was completed; therefore our
challenge was to protect our client’s interests quickly and at a
low cost.

To ensure that the client didn’t incur additional costs, we gave
them a clear strategy to carry out the negotiations themselves.
This included highlighting the potential risks and points that the
media company were likely to raise and suggesting solutions. We
explored different ways to structure the licence and also looked
the relative long term advantages and disadvantages so that we
could present them with a choice of business model. By
understanding our client’s objectives and the potential concerns of
the media company, we provided a solution which satisfied both
sides, ensuring that our client’s rights were protected.
the result:
Our client obtained a lucrative deal, which has since
significantly increased its revenue, without compromising any of
its intellectual property rights. This allowed them to build upon
and develop their product, business and market share.
