implementing anti-counterfeiting product

the challenge:

French Connection, a company famous in the marketplace for its fashion-forward clothing range and design-led products, is an obvious target for counterfeiters seeking to cash in on a company’s prestige. Historically, the business addressed this problem by filing a “watch” with customs, arranging for Her Majesty's Revenue & Customs (HMRC) to seize counterfeit items by providing a short witness statement. However, with the introduction of new HMRC procedures, instead of simply providing a witness statement there is now significant burden on the rights holder to confirm that goods are counterfeit by taking legal proceedings. French Connection felt that having to file court proceedings in respect of each and every shipment detained would place unworkable pressure on the company.

our approach:

Shortly after HMRC changed its practice, we discussed this matter with French Connection’s anti-counterfeiting team and agreed on an appropriate case in which to implement our anti-counterfeiting product. Being instructed from the outset allowed us to take French Connection through a step by step process which meant that the detained garments were swiftly identified, the consignee challenged and HMRC notified.

the result:

Faced with our swift and robust action, the consignee consented to HMRC disposing of the counterfeit goods which avoided the cost of our client having to bring legal proceedings. Although French Connection had resolved to take proceedings to protect its brand and customer base, our concerted action had rendered this unnecessary. Counterfeit goods had been identified, detained, seized and destroyed at modest and predictable cost.
